David A. Cohen

David Cohen joined The Basil Law Group, P.C. in January 2016. He is licensed to practice law in New York, New Jersey, Pennsylvania and the District of Columbia. Mr. Cohen’s practice areas include labor and employment law as well as complex and class action litigation.

Labor and Employment Law

Mr. Cohen has extensive experience in labor and employment law, representing both management and employees. He has successfully represented employers in suits alleging employment discrimination, including claims under Title VII and the Age Discrimination Act.

He has also represented unions and union members in arbitrations and in cases before the National Labor Relations Board alleging unfair labor practices, and has also represented workers alleging employment discrimination and unlawful discharge. Over the past fifteen years, Mr. Cohen has represented truck drivers in employment-related actions in federal and state courts. Recently, Mr. Cohen won a landmark case in federal court in New Jersey in which a court, for the first time, entered a permanent injunction against a motor carrier for violating the federal “Truth-in-Leasing” regulations. These regulations are designed to protect the economic interests of truck owner-operators.

Mr. Cohen is a member of the American Bar Association, Labor and Employment Law Section. He has co-authored digests of current case-law involving wage and hour issues for ABA publications.

Complex and Class Action Litigation

Mr. Cohen is no stranger to the courtroom. He has tried 29 civil cases to jury verdict in state and federal courts. His success in trial is reflected by the favorable verdicts he obtained for his clients. As counsel for defendants in products liability suits, Mr. Cohen obtained eight defense verdicts in state courts that are generally not favorable to corporate defendants.

As counsel for plaintiffs, he successfully tried two class actions cases in bench trials in federal court. The classes in these cases were comprised of thousands of truck owner-operators, and Mr. Cohen obtained judgments in favor of the classes totaling more than five million dollars. He has also settled several large class action cases and the aggregate amount secured for class members has exceeded $15 million.

Mr. Cohen has extensive experience in all facets of litigation, from drafting pleadings, taking depositions, preparing and deposing expert witnesses, and writing motions and briefs. He has also written numerous briefs before both state and federal appellate courts. He has argued cases before the United States Courts of Appels for the Seventh and Eighth Circuits, as well as before the state appellate courts in Pennsylvania and New Jersey.
